Section 39-1-15-100 - Notice to Public/Place of PublicationNotice to the public of Commission hearings when required shall be given in accordance with Miss. Code Ann. § 77-3-47 or other applicable provisions of the Act. Notice of proposed rule adoption shall also be furnished pursuant to Miss. Code Ann. § 25-43-1.101 et seq., 25-43-2.101 et seq; and 25-43-3.101 et seq.
1. Contents of Notice of HearingThe notice shall specify the docket or identifying number of the proceeding, contain a brief description of the nature of the proceedings, the name and address of the public records officer and shall, in addition, contain:
a. A statement of the date, time and place of any public hearing proposed; and/orb. A statement of the date by which objections, interventions, protests or comments must be filed in order to be considered by the Commission.2. Contents of Notice of Proposed Rule AdoptionThe notice shall include:
a. A short explanation of the purpose of the proposed rule and the Commission's reasons for proposing the rule;b. The specific legal authority authorizing the promulgation of rules;c. A reference to all rules repealed, amended or suspended by the proposed rule;d. Subject to Miss. Code Ann. § 25-43-2.101(5), the text of the proposed rule;e. Where, when and how persons may present their views on the proposed rule; andf. Where, when and how persons may demand an oral proceeding on the proposed rule if the notice does not already provide for one.3. When Notice RequiredNotice to the public as provided for herein shall be given in the following instances:
a. Whenever required by statute or Commission regulation.b. Prior to the conducting of any public hearing, if required by law or Commission regulation.c. Whenever, in the discretion of the Commission, notice is deemed appropriate or necessary.4. Proof of NoticeProof of publication and of notice shall be filed by the Executive Secretary among the papers and documents in the Commission files.
