Rule 21-201-6.14 - Recommendation of the Hearing Officer and Decision of the Commission

All findings of fact made by the hearing officer shall be based upon clear and convincing evidence. The hearing officer shall reduce his recommendations to writing and submit those recommendations to the Commission. The hearing officer shall include written recommendations regarding penalties, if any. The hearing officer shall appear before the Commission upon request to participate in deliberation required to render a decision on the merits. The Commission can enter a final order dismissing the case, modifying the report and recommendation, or adopting the report and recommendation, or the Commission can enter an order remanding the case for further hearing.
