Rule 21-201-6.1 - Prehearing Phase

Upon a finding that probable cause exists to believe a violation of law has occurred, the commission shall set a hearing on the matter and shall cause a written notice of the time and place of the hearing to be served upon the respondent at least sixty (60) calendar days prior to the hearing date. A finding of probable cause shall constitute removal of the statutory confidentiality imposed by Sections 25-4-21 and 25-4-23, as authorized in Section 25-4-17(g), Miss. Code of 1972. The executive director shall cause a copy of the written notice to be served on the respondent by personal service or by mailing a copy thereof by certified mail, postage prepaid, to the last known business address of the respondent or his or her attorney.
