A person employed by an appointing authority in any of the following ways shall serve a probationary period:
A. appointment from an eligible register other than the layoff list;B. reinstatement of a former probationary employee or of a former permanent employee in an agency other than the last employing agency;C. transfer of an employee between counties except when specifically waived, in writing to the merit system supervisor, by the new employing county prior to the date on which the transfer of a permanent employee becomes effective; orD. transfer or reinstatement to a position on the basis of eligibility from a comparable position in a similar merit system jurisdiction. An appointing authority may effect a probationary period in an employment action in which such period is not required as specified above by writing this condition of appointment on the appointment report submitted to the merit system. In no case, however, may a probationary period be required of a permanent employee who is appointed from the layoff list.
