Part 7045.0810 - MIXTURES OF USED OIL WITH FUEL PRODUCTS AND REUSE OF USED OILA. Except as provided in items B and C, mixtures of used oil and fuels or other fuel products are subject to regulation as used oil under parts 7045.0790 to 7045.0990.B. Mixtures of used oil and diesel fuel mixed on-site by the generator of the used oil for use in the generator's own vehicles are not subject to regulation as used oil under parts 7045.0790 to 7045.0990 once the used oil and diesel fuel have been mixed. Prior to mixing, the used oil is subject to the requirements of part 7045.0855.C. Persons intending to use used oil or materials contaminated with used oil either as an ingredient in a product or as a product used in a dissimilar manner from the original intended use of the oil must submit information to the commissioner: (1) explaining how the product will be used in a manner that does not constitute improper disposal under part 7045.0845; and(2) proving that the product will not exhibit the toxicity characteristic of part 7045.0131, subpart 7, such as proof that the used oil used in the product does not exhibit the toxicity characteristic. Additional proof must be submitted to the commissioner if the source or nature of the used oil used in the product or as the product changes in a manner that may cause the product to exhibit the toxicity characteristic.D. Used oil that is reused for its original intended purpose or a similar purpose without first being processed is not subject to regulation under this chapter.Minn.
