Section R. 792.10438 - Proceedings within 90 days after dismissal

Rule 438. When an application, petition, or complaint has been dismissed by the commission because the party instituting the proceeding failed to appear and proceed at the hearing, the commission shall refuse, except for good cause, to accept for filing an application, petition, or complaint relating to the same or substantially the same subject matter from the same party for a period of 90 days after the date of a commission order dismissing the case.
