Section 11.19.05.01 - Physical ExaminationA. A school vehicle driver shall pass a physical examination before employment and once during each 12 months of employment.B. The physical examination under §A of this regulation shall be conducted by a medical examiner as defined in the Federal Motor Carrier Safety Regulations, 49 CFR § 390.5, which is incorporated by reference.C. A licensed optometrist may perform as much of the medical examination as pertains to visual acuity, field of vision, and ability to recognize colors as specified in 49 CFR § 391.41(b)(10), which is incorporated by reference.D. The medical examination shall be conducted in accordance with 49 CFR § 391.43, which is incorporated by reference.E. Except as provided in Regulation .01-1A of this chapter, a school vehicle driver shall meet the same physical qualifications required for drivers under 49 CFR § 391.41(b), which is incorporated by reference, except that the physical disqualification waiver provisions of 49 CFR § 391.49 do not apply.F. The medical examiner shall: (1) Record the results of the medical examination on forms approved by the Administration;(2) Forward the results of the medical examination to the driver's employer or owner of the school vehicle; and(3) Complete a medical examiner's certificate for individuals qualified to drive a school vehicle.G. A copy of the medical examination report and certificate shall be retained by the employer or owner of a school vehicle. If the owner of the school vehicle is under contract to provide services by the local board of education, a copy of the report and certificate shall be retained by the local board of education. These copies shall be available for inspection.Md. Code Regs. 11.19.05.01
