Section 11.11.02.05 - PostponementsA. Postponements may be granted only for good cause by the Administrator, or the Administrator's designee. In addition, in cases in which an administrative law judge is the trier of fact, the chief administrative law judge, the Manager of the Division of Administrative Adjudication, or their appointees may grant a postponement for good cause. However, once an administrative law judge is assigned a case, the administrative law judge may, for good cause, grant a postponement.B. Except for good cause, a request for a postponement of a hearing may not be considered unless a written request for it has been received by the Administration not less than 5 days before the scheduled date of the hearing. The written request shall set forth the reasons for the request and shall list at least three dates within the 60-day period following the day of the previously scheduled hearing on which the party and, if applicable, counsel will be available for a hearing.C. A postponement request shall constitute a waiver of the licensee's right to a hearing or a decision within the time periods established by law.Md. Code Regs. 11.11.02.05
