Section 08.08.08.01 - Right of AppealA. A person who is aggrieved by a decision of the lake manager relating to a permit application or permit violation may file a written appeal with the Secretary of the Department of Natural Resources not later than: (1) 30 days after the date of the lake manager's final decision; or(2) If the lake manager fails to act, 30 days from the last date the lake manager may act under COMAR 08.08.05.01D(2).B. The Secretary shall provide a contested case hearing on the appeal and issue a final decision in accordance with State Government Article, Title 10, Subtitle 2, Annotated Code of Maryland, and COMAR 08.01.04.C. A person who is aggrieved by a final decision of the Secretary may seek judicial review of the decision in accordance with State Government Article, Title 10, Subtitle 2, Annotated Code of Maryland, and COMAR 08.01.04.Md.
