A. Notice of a public hearing within the scope of these rules shall be given at least twenty (20) days prior to the date of the hearing to: 1. The registrant or proposed registrant of the pesticide which is the subject of the hearing;2. Any person who has filed with the Department or Board a written request for notice of rule-making on this subject within the past year;3. Any trade, industry, professional, environmental, interest group or regional publication that the Department or the Board deems effective in reaching the persons affected; and4. The Secretary of State for publication in accordance with 5 M.R.S.A. § 8053.5. B. In the case only of a proposed determination by the Commissioner to refuse registration, or to cancel or suspend registration of a pesticide, pursuant to 7 M.R.S.A. §609, notice shall be delivered to the registrant or proposed registrant by registered mail, return receipt requested. In all other cases, notice shall be delivered by first class mail to the last known address of the person or group to be notified.C. The notice shall specify: 1. The statutory authority pursuant to which hearings will be held;2. The time and place of the public hearing;3. The manner and time within which data, views or arguments may be submitted for consideration by the Commissioner and the Board, including the requirements and time limits for filing pre-filed testimony;4. The express terms of any Proposed rule of the Commissioner or the Board, or a summary thereof, stating the subjects and issues involved and indicating where a copy of the complete text of the proposal can be obtained;5. The time period during which applications for intervenor status must be filed; and6. The time of the prehearing conference.
