Section I-1127 - Effect of Declaratory RulingsA. A declaratory ruling is not binding on the department except as to the parties and does not constitute a rule as defined in R.S. 49:951 nor does its issuance require "rulemaking" as defined in R.S. 49:951.B. A declaratory ruling may be used by the petitioner as a defense in any enforcement proceeding brought by the department after the issuance of the ruling.La. Admin. Code tit. 33, § I-1127
