Rule 571-13.17 - Civil penalties

The department may assess a civil penalty of up to $5,000 per offense for each violation of these rules, provided the department does not utilize a criminal citation for a violation. Each day the violation continues shall be a separate offense or violation. Penalties shall be assessed through issuance of an administrative order of the director which recites the facts and the legal requirements that have been violated and a general rationale for the prescribed fines. The order also may be combined with any other order authorized by statute for mandatory or prohibitory injunctive conditions and is subject to normal contested case and appellate review under procedures in 571-Chapter 7. The proposed decision in a contested case may be appealed to the commission under 571-Chapter 7. The commission may refer orders that include singular or cumulative penalties over $10,000 to the attorney general's office.
