Rule 571-13.1 - Purpose

The commission holds lands and waters under its jurisdiction in public trust and protects the interests of all citizens in these lands and waters.

(1) These rules establish procedures and regulate the evaluation and issuance of permits for construction or other activities that alter the physical characteristics of public lands and waters under the jurisdiction of the commission, including those activities that occur over or under such lands and waters. However, these rules do not apply to activities accomplished by the department and its agents that would only temporarily alter the characteristics of public lands and waters and that would be considered management practices.
(2) These rules also establish procedures for issuance of easements to public utilities and political subdivisions for activities that are determined to have a permanent effect on use and enjoyment of public lands and waters under the jurisdiction of the commission.
(3) These rules do not apply to:
a. Impoundments regulated under Iowa Code chapter 462A.
b. Docks regulated under 571-Chapter 16, except as specified herein.
c. Stationary blinds regulated under rule 571-51.6(481A).
