Rule 21-45.18 - Shipments for experimental useA pesticide shipped or delivered for experimental use shall not be considered a violation of section 206.11(1) of the pesticide Act.
(1) When the pesticide is shipped or delivered for experimental use under the supervision of any federal or state agency authorized by law to conduct research.(2) By others if the pesticide is not sold and if the container thereof is plainly and conspicuously marked "For Experimental Use Only-Not To Be Sold".(3) Or provided that a written permit has been obtained from the secretary either specific or general subject to such restrictions or conditions as may be set forth in the permit. The application for such a permit shall contain such information as may be required by the secretary; and in addition the proposed labeling thereon shall bear (1) the prominent statement "For Experimental Use Only" on the container label; (2) a caution or warning statement which may be necessary and if Cornplied with adequate for the protection of those who may handle or be exposed to the experimental products; (3) the name and address of the applicant; (4) the name or designation of the formulation; (5) if the pesticide is to be sold, the statement of the names and percentages of the principal active ingredients in the product.(4) A pesticide intended for experimental use shall not be offered for general sale by a retailer or others, or advertised for general sale.Iowa Admin.
