Rule 199-15.9 - System emergenciesFor purposes of this rule, "electric utility" means a rate-regulated electric utility. Qualifying facilities and AEP facilities shall be required to provide energy or capacity to an electric utility during a system emergency only to the extent:
(1) Provided by agreement between the qualifying facility or AEP facility and the electric utility; or(2) Ordered under Section 202(c) of the Federal Power Act. During any system emergency, an electric utility may immediately discontinue:a. Purchases from qualifying facilities and AEP facilities if purchases would contribute to the emergency; andb. Sales to qualifying facilities and AEP facilities, provided that the discontinuance is on a nondiscriminatory basis.Iowa Admin. Code r. 199-15.9
