Rule 191-73.12 - Election-disclosure and confidentiality
(1) A HIPC may elect to preclude for a period of time a participant who leaves the HIPC from returning to the HIPC to purchase health insurance or health care benefits. However, a HIPC shall not use this subrule to discriminate against high-risk participants.
(2) Subject to review and approval by the commissioner, a HIPC may provide restricted access to information in its possession which is essential to the operation of the HIPC.

Confidentiality must:

a. Be an inducement for voluntary participation in the program;
b. Protect the privacy of participants;
c. Protect negotiating strategy from disclosure to contractors or competitors; or
d. Protect proprietary information in like circumstances as for insurance.
