Rule 185-10.7 - Presiding officer(1)Administrative law judge. The administrator may appoint an administrative law judge as presiding officer in all contested case hearings pursuant to Iowa Code sections 123.32 and 123.39.(2)Appeal. Except as provided otherwise by another provision of law, all rulings by an administrative law judge acting as presiding officer are subject to appeal to the administrator. A party must seek any available intra-agency appeal in order to exhaust adequate administrative remedies.(3)Administrator's review. Unless otherwise provided by law, the administrator, when reviewing a proposed decision upon intra-agency appeal, shall have the powers of and shall comply with the provisions of this chapter which apply to presiding officers.Iowa Admin.
