Section 832 IAC 7-2-6 - Duplicate contracts

Sec. 6.

In the event there is more than one (1) preneed contract to provide the same or similar services or merchandise without a successor seller designated, the contract that is first in time prevails and is valid. The seller of a subsequent contract who has not been designated as a successor seller shall, on demand of the purchaser, refund to the purchaser from trust all funds or other property paid to the subsequent seller in the funding of the subsequent contract. The seller of the subsequent contract shall execute whatever documents are necessary to effectuate the transfer or refund.
