Section 16.03.10.009 - BACKGROUND CHECK REQUIREMENTS
01.Compliance With Department Background Check. Employees and contractors of agencies working in the area under Subsection 009.03 of this rule must comply with the provisions in IDAPA 16.05.06, "Criminal History and Background Checks."
02.Providers Subject to Background Check Requirements. The following providers are required to follow background check requirements provided in these rules and any other identified rules:
a. Adult Day Health Providers.
b. Adult Residential Care Providers.
c. Attendant Care Providers.
d. Behavior Consultation or Crisis Management Providers.
e. Certified Family Home Providers and All Adults in the Home. See additional background check requirements under IDAPA 16.03.19, "Certified Family Homes."
f. Chore Services Providers.
g. Companion Services Providers.
h. Day Habilitation Providers.
i. Developmental Disabilities Agencies (DDA). See additional background check requirements for DDA and staff under IDAPA 16.03.21, "Developmental Disabilities Agencies (DDA)."
j. Homemaker Services Providers.
k. Non-Medical Transportation Providers.
l. Personal Assistance Agencies Acting as Fiscal Intermediaries. The background check requirements applicable to the staff of personal assistance agencies acting as fiscal intermediaries.
m. Personal Care Providers.
n. Residential Habilitation Providers. See additional background check requirements applicable to residential habilitation providers under IDAPA 16.04.17 "Residential Habilitation Agencies."
o. Respite Care Providers.
p. Service Coordinators and Paraprofessionals.
q. Skilled Nursing Providers.
r. Supported Employment Providers.
s. Therapeutic Consultant Providers.
