Section 17-647-37 - Delays beyond sixty days(a) If noncompletion of the application process by the end of the second thirty-day period is caused by the branch, and the case file is otherwise complete, the branch shall continue to process the original application until an eligibility determination is reached.(b) If the household is determined eligible, and the branch caused the delay in the initial thirty days, the household shall receive benefits retroactive to the day of application.(c) If the initial delay was caused by the household, the household shall receive benefits retroactive to the month following the month of application. The branch shall use the original application to determine the household's eligibility in the months following the sixty-day period.(d) If the noncompletion of the application process by the end of the second thirty-day period is caused by the branch, and the case file is not complete enough to reach an eligibility determination, the branch shall continue to process the original application.(e) If the noncompletion of the application process by the end of the second thirty-day period is caused by the household, the branch shall deny the application and shall require the household to file a new application if the household wishes to participate.
