Agencies, masters, owners, operators, or charterers loading or unloading at Kewalo Basin shall indemnify, defend, and save harmless the HCDA, its members, and employees from and against all losses, claims, demands, and suits for damages, including death and personal injury, and including court costs and attorneys' fees, incident to or resulting from their operations on the property of the HCDA and the use of its facilities except where the HCDA has been proven to be solely and legally negligent.
