Section 12-43-34 - Burden of proof

Unless otherwise ordered or provided by law or statute, the party initiating the proceeding shall have the initial burden of proof, including the burden of producing evidence and the burden of persuasion. The degree or quantum of proof shall be a preponderance of the evidence. If the initiating party meets its initial burden of proof, the burden of proof may shift as provided by law.
