Section 11-45-5 - Proceedings before director(a) When the director has grounds to believe that anyone has violated any provision of these rules or of any order of the director, the director may notify the alleged violator or violators of the alleged violation order and may require that the alleged violator appear before the director at a time and place specified in the notice, and answer the allegations. The notice and order shall comply with the chapter 91, HRS, procedures for contested cases.(b) The director may issue an order for immediate action to protect the public health from an imminent and substantial danger. The director shall provide an opportunity for a hearing within twenty-four hours after service of the order. After a hearing pursuant to this subsection, the director may affirm, modify, or rescind the order as appropriate.
