Section 11-186-6 - Change of health care service requiring a certificate of need(a) The addition or deletion of any standard category of health care service listed in section 11-186-5 is a change of service that requires a certificate of need If a health care facility proposes the addition or deletion of a health care service that is not clearly included in one of the standard categories, the agency shall determine whether or not the change is a change of service that requires a certificate of need(b) Any change of location of a health service is a change of service that requires a certificate of need unless the agency determines in writing that the change of location does not significantly affect the delivery of service to the target group. In making this determination, the agency shall consider: (1) The distance from the old location to the new location;(2) The accessibility and acceptability of the new location to the target group; and(3) Any other factors that the agency deems relevant to an informed determination.(c) The addition or deletion of a mobile service shall require one certificate of need only.(d) The termination of services by a provider of health care services that is ceasing its entire operation shall not require a certificate of need. A provider of health care services that is ceasing its entire operation shall provide written notice to the agency at least ten days before the termination of services. [Eff.
