Section 10-5-32 - Decision to hold hearing, scheduling(a) The commission shall hold a contested case hearing whenever it finds that: (1) Such a hearing is required by Chapter 91, HRS;(2) There is a reason to believe that a law or rule of the commission has been violated;(3) Such a hearing would be in the best interest of one or more of the beneficiaries of the act; and(4) A proceeding by the commission would be in the interest of the department.(b) Whenever the commission determines that a contested case hearing should be held, the matter shall be set for a hearing and a notice of hearing shall be served upon all parties as required by HRS section 91-9.5.[Eff 7/30/81; am and comp 10/26/98] (Auth: HRS § 91-2) (Imp: HRS §§ 91-9, 91-9.5, 91-10)
