Section 64J-4.002 - Application for Repository Participation or Withdrawal
(1) To be eligible for participation as a repository in the prescription drug donation repository program, a medical facility or pharmacy must be in compliance with all applicable federal and state laws, including laws applicable to the storage and distribution of drugs and the appropriate licensure standards, and must hold active, nonrestricted, state-issued licenses or registrations in good standing.
(2) A medical facility or pharmacy must submit a completed DH9006-EPCS-07/2021 "Repository Participation or Withdrawal Form" which is incorporated by reference and available at https://www.flrules.org/Gateway/reference.asp?No=Ref-13985 to the department.
(3) A repository may, after providing notification to the department, distribute donated drugs to another participating repository by using DH9007-EPCS-07/2021 "Transfer Form" which is incorporated by reference and available at https://www.flrules.org/Gateway/reference.asp?No=Ref-13986. Nothing in this paragraph will be construed to limit the transfer of drugs as otherwise permitted by law.
(4) A repository may withdraw from participation in the program at any time by submitting a Repository Participation or Withdrawal Form to the department.
(5) A repository that withdraws from the program will redistribute donated drugs or supplies to another participating repository by using a Transfer Form and must submit a copy of the form to the department. In the event that a redistribution of drugs is not possible, or medications are expired or otherwise compromised, the repository will properly destroy the medications in accordance with Rule 64J-4.006, F.A.C.
