Rule 22-C1100 - MEDICAL MARIJUANA PATIENT RECORDS
1100.1

The Board shall maintain a confidential list of qualifying patients and caregivers to whom it has issued registration identification cards.

1100.2

All information obtained by the Board relating to qualifying patients and caregivers shall be confidential and subject to the protections of the District's privacy laws and privileges, including specifically the following:

(a) Applications and supporting information submitted by qualifying patients and caregivers;
(b) Individual names and other identifying information about qualifying patients and caregivers;
(c) Certifications issued by practitioners;
(d) Information on identification cards; and
(e) Information relating to the qualifying patient's medical condition(s).
1100.3

To the extent consistent with District and federal law, ABCA employees may access confidential records as necessary to perform their official duties.

1100.4

The Board shall verify to law enforcement personnel whether a registration identification card is valid.

1100.5

The Board may disclose confidential information in the course of any judicial or administrative proceeding in response to an order of the court, provided that the Board discloses only the information expressly authorized by such order.
