Section 1401-25.0 - Departmental Report25.1 Beginning in 2026, the Division may survey employers, private plan administrators, and employees on an annual basis to obtain data and feedback regarding their use and experience with the PFML insurance program, whether through the Delaware Paid Leave plan or through a private plan, either insured, self-insured, or grandfathered.25.2 Employers. Employers and private plan administrators may be asked to share the following information including: 25.2.1 Number of employees covered by the program;25.2.2 Number of employees utilizing the PFML program, the type of leave requested, and the length of leave taken;25.2.3 Number of employees who took leave broken down by gender, age, town of residence, and income level;25.2.4 Experience with the PFML administrative system;25.2.5 Whether the program has had a positive impact on recruiting and retaining employees;25.2.6 How the program has benefited the employer;25.2.7 Whether the program had a positive effect on productivity, performance, and profitability;25.2.8 Whether the cost of the program has impacted the employer's business;25.2.9 Whether the employer's operations were negatively impacted as a result of employee's taking leave;25.2.10 Whether the PFML program has increased worker morale and productivity;25.2.11 Whether the employer or private plan administrator experienced abuse of the program; and25.2.12 Any recommendations to improve the program including access to leave, length of leave, type of leave, amount of benefit.25.3 Employees. Employees may be asked to share the following information, including: 25.3.1 Whether the employee took or attempted to take PFML;25.3.2 Whether their claim was approved or denied;25.3.3 The type and length of leave taken;25.3.4 Experience with the PFML administrative system and claim process;25.3.5 Whether paid leave was a factor considered when an employee accepted or remained at their current employment;25.3.6 Whether the employee's cost of the PFML program has negatively impacted the employee;25.3.7 Whether access to paid leave has increased the employee's productivity or performance;25.3.8 Whether access to paid leave has increased employee morale;25.3.9 Any recommendations to improve the program including access to leave, length of leave, type of leave, and amount of benefit.19 Del.
