Part 4 - Member service
4.1. Board members shall serve a term of three years, and individuals may be re-elected to no more than three successive terms. Board terms expire on March 1. However, the first term of a newly-created board (pursuant to Part 2 of this rule) shall serve for three to four years so as to allow the boards to complete three full years of service.
4.2. No board member shall participate in deliberations or vote on any matter in which the member has a direct interest.
4.3. Upon receiving a written request from the board, or in the judgment of the commissioner, the commissioner may terminate the service of a member to a board if:
(a) such action is in the public interest and such action will facilitate the fulfillment of the responsibilities of the board;
(b) a board member no longer meets the requirements under which elected;
(c) the member or permittee fails to meet the provisions of Part 3 of this rule; or
(d) the member or permittee fails or is unable to participate regularly in board work.
4.4. Board service shall be without cost to the state.
4.5. In the event of a vacancy occurring under section 4.3, or a vacancy occurring for any other reason, the commissioner shall, in consultation with the affected board, appoint an individual to serve the unexpired term. Consideration shall be given to those nominees who received a large number of votes in the prior election. Any person appointed by the commissioner must meet the requirements of part 3.1 and 3.3.
