The Department may suspend any certification or license, pending a preliminary inquiry for no longer that ten days, and after affording the certificate or license holder notice and an opportunity for a hearing may suspend, deny, revoke or modify the provisions of any certification or license, if it finds,
(1) That the terms or conditions thereof are being violated or are inadequate to avoid unreasonable adverse effects on the environment, or(2) That the holder of or applicant for the certification or license has made a false or misleading statement in the application, or(3) That the holder of a certification or license has violated any provision of the Massachusetts Pesticide Control Act, or FIFRA, or any regulations, standards, orders, certification, license or permit issued under either, or(4) That the holder or applicant for said certification or license is not competent with respect to the use and handling of pesticides or the use and handling of the pesticide or class of pesticides covered by said individual's certification or license, or(5) That the holder of or applicant for a certification or license does not have in effect or fails to maintain in effect liability insurance in the amounts specified in 333 CMR 10.13.
