Section 30.534 - Unmanifested Waste ReportIf an unmanifested waste shipment arrives at a facility, the owner or operator shall notify the Department immediately upon the arrival of the shipment.
(1) If the facility does not accept the shipment, the owner or operator shall instruct the transporter to take no action until that transporter receives specific instructions from the Department.(2) If the facility accepts the shipment, the owner or operator shall submit an unmanifested waste report to the Department within 15 days of receipt by the facility of the unmanifested hazardous waste shipment. The report shall be on a form prescribed by the Department and shall include the following information: (a) The EPA identification number, name, and address of the facility;(b) The date the facility received the waste;(c) The EPA identification number, name, and address of the generator and the transporter, if available;(d) A description and the quantity of each unmanifested hazardous waste the facility received;(e) The method of treatment, storage, use or disposal for each unmanifested hazardous waste;(f) A brief explanation, if known to the facility, of why the waste was unmanifested; and(g) The certification required by 310 CMR 30.009, signed by the owner or operator of the facility or his agent.(3) Except as provided in 310 CMR 30.535, the provisions of 310 CMR 30.534 shall not apply to hazardous waste generated and transported by a Very Small Quantity Generator in compliance with 310 CMR 30.353(1) through (11).Amended by Mass Register Issue 1404, eff. 11/15/2019.
