Whenever an Eligible Bidder or Carrier believes that certain data or information contained in a bid which is not listed as being proprietary under 211 CMR 44.04(2)(a) or (b) is of a proprietary nature, the Eligible Bidder or Carrier may make a written request to the Commissioner that such information be deemed proprietary for the purposes of M.G.L. c. 176D, §3B. Written requests should specifically identify the information sought to be deemed proprietary and state in detail the reasons for requesting that the information be deemed proprietary. The information will be treated as proprietary until the Commissioner renders a decision.
