Section 40.10 - Administrative Enforcement(1) The Commissioner, in his or her discretion, may compromise or settle any claims under any proceeding brought, or to be brought against a lender for a violation of 209 CMR 40.00, if he or she determines that such compromise or settlement is in the public interest.(2) Nothing in 209 CMR 40.00 shall limit the ability of the Attorney General to enforce the provisions of 209 CMR 40.00, M.G.L. c. 167, §§ 2A through 2G, M.G.L. c. 93A, or M.G.L. c. 183C.Amended by Mass Register Issue 1314, eff. 6/3/2016.
