Section 1.01 - Scope and Construction(1)Procedure Governed. 207 CMR 1.00 shall govern practice and procedure, except with respect to the adoption, amendment, or repeal of regulations pursuant to 207 CMR 2.01: Petition for Adoption, Amendment or Repeal of Regulations, before the Massachusetts Department of Telecommunications and Cable under applicable laws of the Commonwealth of Massachusetts and except where a statute provides otherwise.(2)Definitions. As used in 207 CMR 1.00, except as otherwise required by the context: Adjudicatory Proceeding. As defined in M.G.L. c. 30A, § 1(1).
Department. The Massachusetts Department of Telecommunications and Cable.
Electronic Medium. Any device used to transmit information electronically, including but not limited to facsimile and e-mail.
Presiding Officer. The person who is designated to conduct hearings pursuant to the provisions of 207 CMR 1.06(6)(a).
