Section 1.07 - Special Provisions Relating to Native Americans(1) The Department recognizes the special concerns of Native Americans in the Commonwealth. Accordingly, decisions affecting Native Americans shall respect the unique values of Indian culture, whether or not the Indian child or family in question is a member of an Indian tribe as defined in 25 U.S.C. § 1903(8).(2) The Department shall adhere to the provisions of the Indian Child Welfare Act (25 U.S.C. § 1901 et seq.). Where procedures or rights under Massachusetts law or regulation afford more protection than U.S.C. § 1901 et seq., then the former procedures or rights shall apply.
