Section 170.107 - Grounds for Denial of Designation(A) The Department may deny or refuse to issue designation in the following circumstances: (1) If the applicant fails to meet or conform to the designation criteria and conditions of 105 CMR 170.103; or(2) If a competing application for designation was already granted.(B) An applicant denied designation may reapply when the designation criteria and conditions have been met, providing no other applicant has been designated in the interim.(C) Denial of designation may be appealed in accordance with 105 CMR 170.760.Amended by Mass Register Issue 1486, eff. 1/6/2023.
