Section 120.519 - Supervision(A) A licensee that permits the receipt, possession, use, or transfer of radioactive material by an individual under the supervision of an authorized user as allowed by 105 CMR 120.506(B)(1) shall: (1) In addition to the requirements in 105 CMR 120.753, instruct the supervised individual in the licensee's written radiation protection procedures, written directive procedures in 105 CMR 120.500, and license conditions with respect to the use of radioactive material;(2) Require the supervised individual to follow the instructions of the supervising authorized user for medical uses of radioactive material, written radiation protection procedures, written directive procedures, regulations of 105 CMR 120.500, and license conditions with respect to the medical use of radioactive material; and(3) Require that only those individuals permitted under state and local regulations and specifically trained, and designated by the authorized user, be permitted to administer radionuclides or radiation to patients or human research subjects.(B) A licensee that permits the preparation of radioactive material for medical use by an individual under the supervision of an authorized nuclear pharmacist or physician who is an authorized user, as allowed by 105 CMR 120.506(B)(2), shall: (1) Instruct the supervised individual in the preparation of radioactive material for medical use, as appropriate to that individual's involvement with radioactive material; and(2) Require the supervised individual to follow the instructions of the supervising authorized user or authorized nuclear pharmacist regarding the preparation of radioactive material for medical use, the written radiation protection procedures in 105 CMR 120.500, and license conditions.(C) Unless physical presence as described in other sections of 105 CMR 120.500 is required, a licensee that permits supervised activities under 105 CMR 120.519(A) and (B) shall require an authorized user to be immediately available (by telephone within ten minutes) to communicate with the supervised individual, and able to be physically present within one hour of notification; and(D) A licensee that permits supervised activities under 105 CMR 120.519(A) and (B) is responsible for the acts and omissions of the supervised individual.Amended by Mass Register Issue 1480, eff. 10/14/2022.
