Section 100.430 - Withdrawal of Application for Determination of Need(A) An Applicant may withdraw its Application at any time by sending written notification thereof to the Department. Whenever an Application is withdrawn, all Parties of Record shall be notified by the Applicant.(B) The Commissioner, in his or her discretion, may consider an Application to be withdrawn if an Applicant has failed to provide requested information, or otherwise has failed to prosecute the Application within a reasonable time period.Adopted by Mass Register Issue S1331, eff. 1/27/2017.Amended by Mass Register Issue 1381, eff. 12/28/2018.
