(a) A ward may be transferred without a 24-hour prior notice or an opportunity for an interview if an emergency condition exists which: (1) Requires immediate action and failure to act could result in substantial harm or physical danger to the ward, other wards, staff members, state property, and/or,(2) Would seriously inhibit the effective management of the institution.When an emergency transfer situation occurs, the superintendent shall:
(1) Prepare and deliver to the ward prior to the transfer a "Notice of Transfer" which shall specify: (A) The action to be taken and the reason for such action.(B) The specific reason which justifies the emergency transfer without a 24-hour prior notice or an opportunity for an interview before the transfer.(C) That the ward has a right to an interview following the transfer.(2) Prepare within five days following the transfer a case report which shall state the reason for the transfer and the program objectives for the ward.Cal.
