Section 40243 - Right to be Informed(a) Prior to receiving treatment, project shall inform each patient of all known risks, benefits, and alternatives to any and all treatment. Each patient shall sign an affirmation that his/her right to be informed of all known risks, benefits and alternatives to any and all proposed treatment has been explained in his/her native language, and that he/she understands this right. This requirement may be waived in the case of emergencies, that is, treatment, which if delayed, could immediately jeopardize the life of the person involved or could immediately result in a severe physical disability.(b) In the case of minors, the right to be informed affirmation shall be signed by parent or guardian except in those cases specifically exempted by law.(c) No recipient shall be denied site health care benefits for failure to accept any offered treatment.Cal.
