(a) In lieu of filing a request for a jurisdictional determination pursuant to Section 1234, the owner or operator of a proposed powerplant may file a petition requesting expedited clearance of the proposed powerplant on the basis that it has a generating capacity less than 50 MW. The purpose of this expedited clearance process is to resolve jurisdictional issues involving the definition of generating capacity under Section 2003. All other jurisdictional issues must be processed under Section 1234.(b) All petitions for expedited clearance must be filed with the Docket Unit in accordance with Section 1208 and shall include, but not be limited to, the following information: (1) a description of the exact location of the proposed powerplant;(2) a description of the ownership and control of the proposed powerplant;(3) the generating capacity of the proposed powerplant, including detailed equipment and operation design specifications and auxiliary loads necessary to determine the generating capacity under section 2003;(4) the schedule for developing the proposed powerplant;(5) the name, address, and telephone number of the person or persons responsible for reporting the information;(6) a power sales agreement, if available, showing the amount of power to be sold from the project, and to whom the power is being sold;(7) a declaration dated and signed under penalty of perjury by the petitioner or in the case of a corporation or business association by an authorized officer thereof that the facts stated in the petition are true and correct;(8) the date on which the petition is filed; and(9) other information relevant to the issue of generating capacity.Cal.
