Section 484 - Decertification
(a) A CVSP will be decertified if it fails to adhere to the certification criteria in Part I of the Procedure Manual. Reasons for decertification also include the following:
(1) Failure to meet reporting requirements.
(2) Use of grant funds in a manner inconsistent with the grant application and award.
(3) Any form of fraud, waste, and/or abuse of grant funds as determined by CalVet.
(b) A notice of non-compliance with the certification agreement will be sent to the CVSP by certified mail. The CVSP has 30 days to respond to CalVet from the date of the notice.
(c) If the CVSP fails to address the items listed in the notice of non-compliance, CalVet shall notify the CVSP by mail of the decertification that includes the specific reason for the decertification and instructions on how to appeal the decision.
(d) The CVSP may appeal the decision of CalVet to the Department Secretary using procedures identified in the Procedure Manual, Part III, Section B. However, if the Secretary sustains CalVet's decision, then such decision is final.
