Section 8 AAC 85.840 - Priority of service: Defined(a) An eligible covered person has a priority of service and is given precedence over an eligible non-covered person in obtaining services.(b) If necessary, and in order to ensure the priority of service to an eligible covered person, (1) the eligible covered person will receive access to a service or resource earlier in time than the eligible non-covered person; and(2) if a service or resource is limited, an eligible covered person will receive access to the service or resource instead of or before an eligible non-covered person.(c) In this section,(1) "eligible covered person" includes a veteran and the spouse of any of the following individuals: (A) a veteran who died of a service-connected disability;(B) a member of the Armed Forces serving on active duty who, at the time of application for assistance under this section, is listed in one or more of the following categories and has been listed for a total of more than 90 days: (ii) captured in the line of duty by a hostile force;(iii) forcibly detained or interned in the line of duty by a foreign government or power;(2) "eligible non-covered person" means an individual eligible for services who is not an individual described in (1) of this subsection;(3) "priority of service" means the right of eligible covered persons to take precedence over eligible non-covered persons in obtaining services.Eff. 4/24/2010, Register 194Authority:AS 23.20.045
