Section 22 AAC 05.207 - Initial classification(a) An officer designated by the department shall review a prisoner's case record, including a complete criminal history and all other relevant information, and complete the initial classification form after remand. A prisoner's custody level shall be determined under this section before the prisoner is moved from the booking and intake module.(b) The initial custody level is based on the following matrix factors: (1) severity of current offense;(2) additional felonies and misdemeanors involving violence or escape;(3) severity of prior adult and juvenile offenses;(5) history of institutional violence;(6) number of prior adult and juvenile convictions;(c) An officer designated by the department shall meet with the prisoner and complete a substance abuse screening tool and a risk screening tool and review a prisoner's education level after remand. Any prisoner without a general educational development or high school diploma shall be referred to the institutional education coordinator for testing and educational placement.(d) The officer completing the initial classification form shall submit a recommendation regarding the prisoner's custody level to the superintendent. The superintendent shall approve, disapprove, or modify the initial classification of custody level recommendation no later than three working days after the date of the initial classification. If the recommendation is disapproved or modified, the superintendent shall state the reasons for the disapproval or modification on the classification form.(e) The prisoner shall be provided a copy of the completed initial classification and the superintendent's decision no later than three working days after the date of the decision. A copy of the completed initial classification and any relevant documents shall be placed in the prisoner's case record.(f) A prisoner may request a correction of factual errors on the initial classification form, or of a significant change in status that may affect the prisoner's custody level, by submitting a request for interview no later than three working days after the prisoner's receipt of the initial classification documents. No later than three working days after the date that the prisoner receives a response to the request for interview, the prisoner may appeal the response to the request for interview to the superintendent under 22 AAC 05.242.Eff. 1/13/2012, Register 201Authority:AS 33.30.011
