Section 20 AAC 05.776 - Definitions

In 20 AAC 05.772 - 20 AAC 05.775, unless otherwise specified,

(1) "commercially harvested" means the lawful taking and selling of shrimp caught with pot gear by an interim-use permit holder from a vessel registered for the Southeastern Alaska shrimp pot fishery under 5 AAC 31.020 and licensed for commercial fishing under AS 16.05.490, where the shrimp sales were in accordance with regulations governing the sale or use of commercially caught shrimp applicable at the time of sale, including regulations regarding proper completion of reports required of processors, buyers, and fishers; "commercially harvested" does not include deadloss, shrimp retained for personal use, shrimp caught as bycatch or from experimental or exploratory fisheries, or shrimp that is confiscated or donated;
(2) "joint operation" means a partnership or any other agreement by which two or more individuals function as joint operators;
(3) "joint operators" means a partner or other party to an agreement by which two or more individuals are physically present on, and participate from, the same vessel and are in control or joint control of the commercial fishing operation;
(4) "participation" means the applicant was physically present on a vessel registered for the Southeastern Alaska shrimp pot fishery under 5 AAC 31.020 and licensed for commercial fishing under AS 16.05.490, had a valid interim-use permit for the fishery, and actively engaged in a commercial fishing operation that commercially harvested the shrimp resource with pots;
(5) "pounds" means actual pounds of whole shrimp recorded on fish tickets, if the weight for shrimp tails is recorded on fish tickets, pounds of whole shrimp is calculated by multiplying tail weight by the Department of Fish and Game's conversion factor of 1.67 for all shrimp species and all size classes of shrimp;
(6) "statistical week" means a time period used by the Department of Fish and Game for statistical comparisons and summaries; the first statistical week of a year starts on the first day of January and ends on the first Saturday in January; all other statistical weeks within the year start on Sunday; and
(7) "week" means any statistical week during which an applicant made an authorized commercial harvest and delivery of shrimp caught with pot gear in the fishery for which the permit is sought.
