Section 20 AAC 05.560 - Annual renewal of entry permit
(a) Application for annual renewal of an entry permit must be made to the commission on a form provided by the commission. If the renewal form is submitted by mail or electronic imaging, the renewal form must be completed and signed by the permit holder, or by an agent authorized in accordance with 20 AAC 05.1960. An applicant may submit an application to renew an entry permit on the online licensing system at the commission's website. The total annual fee for the permit or permits being renewed must be submitted with the application.
(b) An entry permit is forfeited and reverts to the commission if it has not been renewed by December 31 of the second consecutive calendar year after its issuance or last renewal, except as waived by the commission upon demonstration of good cause.
(c) Repealed 11/26/87.
(d) The commission may waive the annual renewal fee of a limited entry permit if the commission finds that a circumstance applicable to all permittees in a fishery has prevented a substantial number of permittees from participating in that fishery including the person requesting the fee waiver. A permittee may request a refund of fees paid for that season by submitting a written request to the commission that specifies the circumstances that prevented the person and a substantial number of other permittees from participating in that fishery. The permit card or compelling evidence of the destruction of the permit card must accompany the request. The commission may require a permittee to submit affidavits or other evidence in support of a request for a refund.
(e) Before the commission will issue an entry permit card in a given year, the annual renewal form submitted to the commission must show the ADF&G number of the vessel on which the card is to be used, and, except when excused for good cause or exempt by law, the vessel so designated must be licensed for that year.
(f) A person applying for the annual renewal of an entry permit who needs to fish immediately, and has not yet renewed, applied for renewal, or paid the current year fees for an entry permit, may instead apply using the Application for Immediate Fishing form provided by the commission. The application form may be used for fishing only if the form has been submitted to the commission through commission staff or an agent of the commission who has certified the form is complete by signing it. The signed application form may be used for fishing for no more than the 14 days immediately following the date that the form is signed by commission staff or an agent of the commission, unless extended by the commission. In addition to the total annual fee for the permits and vessel licenses being applied for, a processing fee of $80 must be submitted with the application. The commission may waive the processing fee for
(1) an applicant who qualifies for the reduced permit fee in accordance with 20 AAC 05.245; or
(2) good cause shown.
(g) For the purposes of receiving and certifying as complete an Application for Immediate Fishing form submitted under (f) of this section, an employee of the Department of Fish and Game or the division in the Department of Public Safety responsible for the enforcement of laws for the protection of fish and wildlife, is an agent of the commission.
