Section 20 AAC 05.1815 - Scope of hearing(b) If the hearing officer determines that a genuine issue exists regarding the interpretation of a regulation or statute, and that no facts are in dispute, the hearing officer may order that the issue be decided without holding an evidentiary hearing. The hearing officer shall submit a statement of issues to the applicant or other party and provide a reasonable time to submit oral or written argument. The scope of arguments must be limited to the issues listed in the hearing officer's statement.
