Section 2 AAC 90.480 - Change of certain information on driver's license or identification card
(a) Under this section, and on an application form or in a format specified by the department, a person may apply to change the following items appearing on the applicant's Alaska driver's license or identification card:
(1) address;
(2) date of birth;
(3) legal name;
(4) physical description.
(b) Under AS 28.35.135, no later than 30 days after a person's change in legal name or address of record maintained by the department under AS 28.05.071 for a driver's license or identification card, the person must notify the department of the change on the form or in a format prescribed by the department or by other verbal, written, or electronic transmission specified by the department. The department may accent a request for change of name or address made later than 30 days for good cause shown; "good cause" includes unnecessary burden or expense to the department or the applicant.
(c) Except as otherwise provided in this section, an application to change a person's date of birth, full legal name, or physical description must include at least one of the documents specified in 2 AAC 90.420(b). If necessary in order for the department to make a determination under (a)(4) of this section, the department will require an applicant to submit a certification from a licensed
(1) physician in medicine or osteopathy;
(2) social worker;
(3) psychologist;
(4) professional counselor;
(5) physician assistant; or
(6) advanced nurse practitioner.
(d) A certification provided under (c) of this section must be made under penalty of unsworn falsification on a form furnished by the department. The form must include the licensed provider's full name, address, telephone number, professional license number, license-issuing jurisdiction, original signature, and a statement certifying that
(1) the licensed provider has treated the applicant or reviewed and evaluated the medical history of the applicant with regard to the condition necessitating the requested change;
(2) the applicant has had appropriate clinical treatment for the condition necessitating the change; and
(3) the change is expected to be permanent.
(e) The department will accept, but will not require, documentation to change height, weight, or eye color on a driver's license or identification card.
(f) Except as otherwise provided in AS 28.15.111(a), upon processing an application or request for a change of date of birth, full legal name, or physical description made in compliance with AS 28.15 and this section, the department will issue the applicant a duplicate or renewed driver's license or identification card displaying the requested change and may include a new photograph
(g) Upon processing an application or request for a change of address, the department may issue the applicant a duplicate or renewed driver's license or identification card displaying the requested change and and may include a new photograph.
(h) Notwithstanding (a) - (g) of this section, the department may correct a manifest clerical error on a driver's license or identification card.
(i) In this section, "physical description" means sex, height, weight, or eye color.
(j) If a person applies for a change of name based on a court order, the department shall issue the duplicate or renewed driver's license or identification card only in the name exactly as displayed on the court order.
(k) If a person applies for duplicate or renewed driver's license or identification card to reflect a name change based on marriage, the documents issued by the department may only reflect a change to the applicant's middle name, last name, or a combination of middle and last names. An applicant may present a certified copy of a marriage certificate as evidence of a change to the applicant's middle or last name. An applicant must present a court order to request a change in the person's first name, including a change to the spelling of any part of the first name.
(l) If a person applies for a duplicate or renewed driver's license or identification card to reflect a name change based on a dissolution, divorce decree, or annulment, the court order must specify the person's new name or that the person is reverting to the person's name used before the marriage. If the person is reverting to the person's name used before the marriage, the name must be identifiable from documentation presented by the applicant.
(m) The department may require that the applicant surrender the applicant's previously issued driver's license or identification card to the department when the department issues a new driver's license or identification card in a changed name
