Section 18 AAC 90.030 - Distribution, sale, and purchase requirements(a) A person may not distribute or sell(1) any pesticide unless it has been registered as required by 18 AAC 90.200 - 18 AAC 90.235; or(2) a restricted-use pesticide unless the person is a certified pesticide dealer and has proof that the purchaser is (A) certified under this chapter in the applicable category of use; or(B) authorized in writing by an applicator certified in the applicable category of use to purchase the restricted-use pesticide for use by the certified applicator.(b) a person may not purchase a restricted-use pesticide unless that person is (1) certified under this chapter in the applicable category of use; or(2) authorized in writing by an applicator certified in the applicable category of use to purchase a restricted-use pesticide for use by the certified applicator.Eff. 2/15/98, Register 145; am 9/30/2007, Register 183Authority:AS 46.03.010
