Section 18 AAC 80.810 - Invalidation of fecal indicator-positive samples(a) Under 40 C.F.R. 141.402(d), adopted by reference in 18 AAC 80.010(a), the department will invalidate a fecal indicator-positive sample if (1) the certified laboratory that performed the analysis establishes that improper sample analysis caused the positive result; or(2) the department, based on the results of triggered source water samples collected under 40 C.F.R. 141.402(a), adopted by reference in 18 AAC 80.010(a), finds that the fecal indicator-positive sample resulted from a domestic or other nondistribution system plumbing problem; the department will not invalidate a sample on the basis of repeat sample results.(b) If the department invalidates a fecal indicator-positive sample under (a) of this section, the department will (1) document the decision in writing;(2) make the decision available to EPA and the public; and(3) describe the specific cause of the fecal indicator-positive sample and what action the owner or operator of the system has taken or will take to correct that problem.(c) A fecal indicator-positive sample invalidated under this section may not be counted toward meeting the additional five source water samples required under 40 C.F.R. 141.402(a)(3), adopted by reference in 18 AAC 80.010(a).Eff. 5/20/2011, Register 198Authority:AS 46.03.020
